Credential Integrity & Enforcement Policy
This page outlines the prohibition against copying our stacked-credential model and the remedies we will pursue to protect our candidates, partners, and marks.
1) Prohibition
Any attempt by another certifying body or board to reproduce, replicate, or market a “multi-certification from one exam” program that creates confusion with NHCWA® or NHWCA™ credentials is strictly prohibited. This includes copying or imitating our credential names, stacked-credential structure, pathways, or exam/skills content.
2) Immediate Remedies
Cease-and-Desist
Upon detection, we will issue formal cease-and-desist notices to halt further misuse and demand corrective actions.
Injunctive Relief
We will seek court orders to stop continued infringement or unfair competition, including temporary and permanent injunctions.
Monetary Remedies
We will pursue compensatory and, where applicable, statutory damages, as well as recovery of attorneys’ fees and costs to remediate harm to our organizations, credential holders, and employers.
3) Registrant & Employer Protection
Enforcement actions are intended to protect students, certificants, employers, and the public from confusion, fraud, or dilution of credential value caused by unauthorized credentialing schemes.
4) No Waiver
Failure to act immediately in any given instance does not constitute a waiver of any rights in future instances. NHCWA® and NHWCA™ reserve all rights and remedies at law and in equity.
